<h1>1. Introduction</h1>
<p>WCSitters LLC (“WCSitters,” “we,” “us,” or “our”) is a Pennsylvania limited liability company that operates an online marketplace at wcsitters.com (the “Platform”) connecting college-student babysitters (“Sitters”) with families (“Families”) in the greater Philadelphia area.</p>
<p>This Privacy Policy explains how we collect, use, share, and protect information about you when you use our Platform, our website, or our related services (collectively, the “Services”). By using the Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.</p>
<p>This Privacy Policy is part of, and is incorporated into, our Terms of Service. Capitalized terms not defined here have the meanings given in our Terms of Service.</p>
<h1>2. Who This Policy Applies To</h1>
<p>This Privacy Policy applies to:</p>
<ul>
<li>Sitters who create an account or apply to join the Platform;</li>
<li>Families who create an account, book Sitters, or use the Platform to find childcare;</li>
<li>Visitors to wcsitters.com; and</li>
<li>References, contacts, and other third parties whose information we receive in connection with the Services.</li>
</ul>
<h1>3. Information We Collect</h1>
<p>We collect information in three ways: (a) information you provide to us directly; (b) information we receive from third parties (such as background check vendors and payment processors); and (c) information we collect automatically when you use the Services.</p>
<h2>3.1 Information You Provide to Us</h2>
<p>Account Information. When you create an account, we collect your name, email address (Sitters must use a verified .edu address), phone number, password, and date of birth (to confirm you are at least 18).</p>
<p>Sitter Profile Information. If you apply to be a Sitter, we collect additional information including:</p>
<ul>
<li>Your photo and a required intro video (approximately 30 seconds) that you record through the Platform;</li>
<li>College or university, major, expected graduation year, and hometown;</li>
<li>Babysitting and childcare experience, including years of experience, age groups served, and specialized care experience;</li>
<li>Certifications you self-report (such as CPR or First Aid);</li>
<li>Languages spoken, comfort with pets, ability to drive children, willingness to perform light household tasks, and similar profile details;</li>
<li>Your desired family-facing hourly rate;</li>
<li>Names, email addresses, and phone numbers of references you submit;</li>
<li>Government-issued identification and other documents required to complete background screening and Stripe Connect onboarding.</li>
</ul>
<p>Family/Booking Information. If you are a Family, we collect information including:</p>
<ul>
<li>Your home or service address and contact information;</li>
<li>The number, ages, and first names of children to be cared for;</li>
<li>Booking dates, times, location, and special instructions (such as allergies, medications, behavioral notes, house rules, and emergency contacts);</li>
<li>Reviews, ratings, and feedback you provide about Sitters.</li>
</ul>
<p>Payment Information. Payments are processed by Stripe, Inc. through Stripe Connect Express. You provide payment card or bank account information directly to Stripe; we do not store full payment card numbers on our servers. We receive limited transaction information from Stripe, such as the last four digits of a card, transaction amounts, payout status, and tax-reporting information.</p>
<p>Communications. When you contact us by email, in-app messaging (available only after a booking is confirmed), text message, or any other channel, we collect the content of those communications, attachments, and associated metadata (such as time stamps and sender/recipient information).</p>
<p>Other Information You Submit. We also collect information you choose to provide in surveys, applications, support requests, or otherwise.</p>
<h2>3.2 Information From Third Parties</h2>
<p>Background Check Information. Sitters authorize us, through a separate disclosure and authorization, to obtain consumer reports including:</p>
<ul>
<li>National criminal background check results from Checkr, Inc., including sex offender registry checks and identity verification.</li>
</ul>
<p>We treat these reports as confidential and use them only to make eligibility decisions for the Platform. See Section 7 for FCRA-related details.</p>
<p>Reference Information. We collect the responses, comments, and contact information that references provide when responding to our verification requests.</p>
<p>Verification and Fraud Prevention. We may receive information from identity verification, fraud prevention, and anti-money-laundering providers.</p>
<p>Other Sources. We may receive information about you from our service providers (listed in Section 5), from other users (for example, when a Family books or reviews a Sitter), or from publicly available sources.</p>
<h2>3.3 Information Collected Automatically</h2>
<p>When you use the Services, we and our service providers automatically collect:</p>
<ul>
<li>Device Information — device type, operating system, browser type, language, and unique device identifiers;</li>
<li>Log Information — IP address, access times, pages viewed, referring URLs, and crash data;</li>
<li>Usage Information — features used, search terms, click-stream data, and interactions with Platform content;</li>
<li>Approximate Location — derived from IP address or, with your permission, more precise location to show you Sitters or Families near you;</li>
<li>Cookies and Similar Technologies — see Section 8.</li>
</ul>
<h1>4. How We Use Your Information</h1>
<p>We use the information we collect to:</p>
<ul>
<li>Provide, operate, maintain, and improve the Services;</li>
<li>Create and manage your account and Sitter or Family profile;</li>
<li>Match Sitters with Families and facilitate bookings;</li>
<li>Conduct Sitter vetting, including ordering and reviewing background checks, scheduling and conducting Zoom interviews, and contacting references;</li>
<li>Process payments, calculate the platform fee, issue payouts, and prepare tax documents (including 1099-NEC forms when applicable and an Annual Care Summary for Families);</li>
<li>Verify identity and prevent fraud, abuse, or other harm to users and the Platform;</li>
<li>Communicate with you about your account, bookings, support requests, policy changes, and (with your consent where required) marketing communications;</li>
<li>Send transactional text messages, push notifications, and emails relating to your bookings and account;</li>
<li>Personalize your experience and present Sitters or Families relevant to you;</li>
<li>Monitor, analyze, and report on use of the Services;</li>
<li>Enforce our Terms of Service, Sitter Agreement, Family Agreement, and other policies;</li>
<li>Comply with legal obligations and respond to lawful requests; and</li>
<li>Carry out any other purpose disclosed to you at the time of collection or with your consent.</li>
</ul>
<p>Where required by law, we rely on the following legal bases to process your information: performance of a contract with you, your consent, our legitimate interests (such as operating and securing the Services), and compliance with legal obligations.</p>
<h1>5. How We Share Your Information</h1>
<p>We do not sell your personal information. We share information in the following circumstances. Nothing in this section applies to your mobile information or your consent to receive text messages: those are never shared with third parties or affiliates for marketing or promotional purposes. See Section 11a.</p>
<h2>5.1 Between Sitters and Families</h2>
<p>To make a booking possible, we share certain information between Sitters and Families:</p>
<ul>
<li>Before booking, Families can see Sitter profile information including first name, photo, intro video, college, major, hometown, experience, certifications, languages, age groups, and family-facing hourly rate. Direct contact information is not shared, and direct messaging is locked until a paid booking is confirmed.</li>
<li>After a paid booking is confirmed, we share names, phone numbers, the service address, child information provided by the Family, and any booking-specific instructions, and we unlock in-app messaging between the Family and Sitter. This exchange is solely to perform the booking you requested; it is not a disclosure to a third party or affiliate, and it is never for marketing or promotional purposes.</li>
<li>After a booking, Sitters and Families may exchange ratings and reviews, which other users may be able to view.</li>
</ul>
<h2>5.2 Service Providers</h2>
<p>We share information with third-party service providers that help us operate the Services. Each provider only receives the information needed to perform its function and is contractually required to protect that information. Our principal providers include:</p>
<ul>
<li><strong>Stripe, Inc.</strong> — payments, payouts, identity verification, and tax reporting via Stripe Connect Express;</li>
<li><strong>Checkr, Inc.</strong> — national criminal background checks for Sitters;</li>
<li><strong>Google LLC (Firebase, Cloud, and related services)</strong> — authentication, database, hosting infrastructure, and analytics;</li>
<li><strong>Netlify, Inc.</strong> — web hosting and serverless functions;</li>
<li><strong>Mux, Inc. and Cloudinary, Inc.</strong> — hosting, processing, and delivery of Sitter intro videos and other media;</li>
<li><strong>EmailJS</strong> — transactional email delivery;</li>
<li><strong>Calendly LLC</strong> — scheduling Sitter interviews;</li>
<li><strong>Track1099 (Avalara)</strong> — generation and filing of 1099 tax forms;</li>
<li>Customer support, analytics, error monitoring, and similar operational vendors.</li>
</ul>
<h2>5.3 Legal and Safety Purposes</h2>
<p>We may disclose information if we believe in good faith that disclosure is necessary to (a) comply with applicable law, legal process, or government requests; (b) enforce our agreements, including investigation of potential violations; (c) detect, prevent, or address fraud, security, or technical issues; or (d) protect the rights, property, or safety of WCSitters, our users, children, or others.</p>
<h2>5.4 Business Transfers</h2>
<p>If WCSitters is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction, subject to standard confidentiality protections.</p>
<h2>5.5 With Your Consent</h2>
<p>We may share your information for any other purpose disclosed to you with your consent.</p>
<h2>5.6 Aggregated and De-Identified Information</h2>
<p>We may share aggregated or de-identified information that cannot reasonably be used to identify you for any business purpose.</p>
<h1>6. Background Check Authorization and Consumer Report Disclosures</h1>
<p>Sitters must complete a separate Disclosure and Authorization form, presented during onboarding, before we order a consumer report. That form provides notices required by the federal Fair Credit Reporting Act (FCRA) and Pennsylvania law, including:</p>
<ul>
<li>That a consumer report and/or investigative consumer report may be obtained for employment-related purposes broadly defined;</li>
<li>The right to request additional disclosures about the nature and scope of the report;</li>
<li>The right to a copy of A Summary of Your Rights Under the Fair Credit Reporting Act;</li>
<li>Pre-adverse and adverse action procedures, including the right to dispute information in the report.</li>
</ul>
<p>Background check information is treated as confidential, is used solely for eligibility decisions on the Platform, and is shared only with personnel and service providers with a legitimate need to know.</p>
<h1>7. Cookies and Tracking Technologies</h1>
<p>We and our service providers use cookies, pixels, local storage, and similar technologies to operate the Services, remember your preferences, analyze usage, and improve the Services. You can control cookies through your browser settings; however, blocking some cookies may impair the functionality of the Services.</p>
<p>We do not currently respond to Do Not Track browser signals.</p>
<h1>8. Data Security</h1>
<p>We maintain administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, restricted access controls, and use of reputable infrastructure providers. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for notifying us immediately of any suspected unauthorized access.</p>
<h1>9. Data Retention</h1>
<p>We retain your information for as long as your account is active and for a reasonable period afterward to:</p>
<ul>
<li>Comply with our legal, tax, accounting, and reporting obligations (for example, retaining payment and 1099 records for the periods required by the IRS);</li>
<li>Defend or assert legal claims;</li>
<li>Maintain records of bookings, background check decisions, and disputes for safety, fraud-prevention, and regulatory purposes;</li>
<li>Preserve aggregated or de-identified analytics.</li>
</ul>
<p>When information is no longer needed for these purposes, we delete or de-identify it in accordance with our internal retention schedule.</p>
<h1>10. Children’s Privacy</h1>
<p>The Services are intended for users 18 and older. We do not knowingly collect personal information directly from children under 13. Families may provide information about their children (such as first name, age, allergies, medications, and special instructions) so that Sitters can provide appropriate care; this information is collected from the Family, not the child, and is used only to facilitate the booking and the safety of the child during care. If you believe a child has provided us with personal information without parental consent, please contact us at the address below and we will delete it.</p>
<h1>11. Your Rights and Choices</h1>
<p>Subject to applicable law, you may have the following rights regarding your personal information:</p>
<ul>
<li>Access — request a copy of the personal information we hold about you;</li>
<li>Correction — request that we correct inaccurate or incomplete information;</li>
<li>Deletion — request that we delete your information, subject to retention exceptions;</li>
<li>Objection or Restriction — object to or request that we restrict certain processing;</li>
<li>Portability — request a copy of certain information in a portable format;</li>
<li>Withdraw Consent — withdraw any consent you previously provided, without affecting the lawfulness of prior processing.</li>
</ul>
<p>You can update most account information directly in your profile settings. To exercise any other right, contact us using the information in Section 14. We may need to verify your identity before responding. We will not discriminate against you for exercising any right.</p>
<p>Communications Choices. You may opt out of marketing emails by clicking the “unsubscribe” link in any such email. You may opt out of marketing SMS by replying STOP. You cannot opt out of transactional messages (such as booking confirmations or security notifications) while your account is active.</p>
<h1>11a. SMS / Text Message Communications</h1>
<p><strong>How We Use Your Mobile Number.</strong> When you provide your mobile phone number and consent to receive text messages during account registration, we use it solely to send transactional SMS notifications related to your WCSitters account. These include booking confirmations, appointment reminders, profile status updates, and other account-related alerts.</p>
<p><strong>No Sharing of Mobile Information.</strong> Mobile information and messaging consent will not be shared with third parties or affiliates for marketing or promotional purposes. We do not sell, rent, or share your mobile phone number, or your consent to receive text messages, with any third party or affiliate for marketing or promotional purposes. All of the categories of information described elsewhere in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties or affiliates.</p>
<p><strong>Message Frequency.</strong> Message frequency varies based on your account activity. You may receive up to a few messages per week related to your bookings and account.</p>
<p><strong>Message and Data Rates.</strong> Message and data rates may apply depending on your mobile carrier and plan.</p>
<p><strong>How to Opt Out.</strong> To stop receiving SMS messages, reply <strong>STOP</strong> to any message. You will receive a confirmation and no further messages will be sent. To re-subscribe, reply <strong>START</strong>. For help, reply <strong>HELP</strong> or contact us at admin@wcsitters.com.</p>
<h1>12. State-Specific Privacy Rights</h1>
<p>Residents of certain U.S. states have additional rights under their state’s privacy laws. We do not sell personal information or share it for cross-context behavioral advertising as those terms are defined under applicable law. If you are a resident of California, Colorado, Connecticut, Virginia, Utah, or another state with applicable consumer privacy rights, you may exercise the rights described in Section 11 by contacting us. You may also have the right to appeal a denial of your request by replying to our response.</p>
<h1>13. International Users</h1>
<p>The Services are intended for users located in the United States, and the Platform is currently designed to serve families and Sitters in the Commonwealth of Pennsylvania. If you access the Services from outside the United States, your information will be transferred to, processed, and stored in the United States, which may have data protection laws different from those of your jurisdiction.</p>
<h1>14. Changes to This Privacy Policy</h1>
<p>We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email, through the Platform, or by other reasonable means and update the “Last Updated” date above. Your continued use of the Services after the effective date of any update constitutes your acceptance of the updated Privacy Policy.</p>
